NCAA denies Notre Dame's appeal, wins from 2012 and 2013 still vacated

After appealing a ruling by the NCAA's Committee on Infractions to vacate all wins from the 2012 and 2013 seasons due to an academic misconduct investigation in South Bend, Notre Dame was informed the restoring of vacated wins will not be granted for those two particular seasons.

Notre Dame won 12 games in 2012 and finished as the national runner-up, losing to Alabama in the BCS National Championship Game.

In its decision, the appeals committee highlighted that "as a member of the NCAA, the university is subject to the Association's rules, including those related to academic misconduct and the ability to impose penalties for academic misconduct violations".

Five former Irish football players - Ishaq Williams, Kendall Moore, Eilar Hardy, Davaris Daniels and KeiVarae Russell - were suspended prior to the 2014 season for academic misconduct.

In his own letter to Notre Dame alumni, University President Fr. John Jenkins said "we are deeply disappointed by and strongly disagree" with the appeals committee's conclusion.

In addition to the vacated wins, Notre Dame was slapped with a probation period and a show-cause order for the aforementioned student trainer. The governing organization ruled that the student trainer was not simply a student but rather a "representative of the institution", according to its 2016 report.

The NCAA rejected Notre Dame's appeal of 21 vacated wins, making the Fighting Irish's all-time win total 885.

"Our concerns go beyond the particulars of our case and the record of two football seasons to the academic autonomy of our institutions, the integrity of college athletics and the ability of the NCAA to achieve its fundamental goal", he wrote.

It has to do with ineligible players and has resulted in wins from both the 2012 and 2013 season being vacated.

Notre Dame pulled together a 2018 recruiting class that featured eight All-American selections, 10 guys in's Top 250 and 11 players in ESPN's Top 300 list.

It said she did substantial coursework for two players and gave impermissible help to six others in 18 courses over two academic years.

"There is no precedent in previous NCAA cases for the decision to add a discretionary penalty of vacation of team records in a case of student-to-student cheating involving a part-time student worker who had no role in academic advising".
